For beta testers posting NDA violations on the open forums -- if it was a clearly blatant violation then yeah, we'll usually take action on the account, but if it looks like it was accidental we're fairly forgiving (assuming it only happens once :P).

As far as folks responding to them -- yes, they are subject to the same rules as everyone else.
